Do I need a solicitor for conveyancing in Canberra?
In the ACT, conveyancing is carried out by solicitors and law practices. Unlike some states, there is no separate licensing or registration system for conveyancers who are not solicitors. Titlespace is a law firm, so your Canberra conveyancing is handled by property lawyers as a matter of course.
That also means any money we hold for you sits in a law practice trust account. In the ACT, trust money held by law practices is regulated under the Legal Profession Act 2006, and the Law Society of the ACT oversees trust accounts and examines practitioners’ records. What documents must a seller have ready before listing in the ACT?
The ACT has particularly strong pre-sale disclosure requirements. If you’re selling residential property, the proposed contract and the required supporting documents must be available for inspection by prospective buyers whenever an offer may be made.
That makes early legal preparation especially important in Canberra. What is the cooling-off period in the ACT?
The cooling-off period is a short window in which an eligible buyer can withdraw from a private treaty residential property contract. In the ACT it is five clear working days after the contract is made. Cooling off is not always cost-free: buyers in the ACT who withdraw forfeit 0.25% of the purchase price.

What does it mean that Canberra property is leasehold?
In the ACT you don’t buy freehold land, you buy a long-term Crown lease. It surprises a lot of first-time Canberra buyers, but plenty works exactly as you’d expect. Choosing between joint tenants and tenants in common, for example, works the same way on the lease and is recorded on the ACT Land Titles Register from day one.

I'm buying in Queanbeyan or Googong. Does ACT or NSW law apply?
NSW law. Queanbeyan and Googong sit just over the border in New South Wales, so a property there is a NSW transaction with NSW contract, cooling-off and disclosure rules, even if you work in Civic and shop in Manuka.
